Terms of Service

1. Acceptance and Eligibility

By downloading, installing, or using PixoMap, you agree to these Terms. You must be at least 13 years old to use the service.

2. Purpose and Allowed Use

• PixoMap is a mapping and recommendation app, not a turn-by-turn emergency navigation service.
• You may use PixoMap to create, discover, and share travel and photo routes.
• You must comply with local laws and respect property rights and access restrictions.

3. Prohibited Use

• Illegal activities, harassment, stalking, or surveillance.
• Misuse of content that infringes intellectual property or privacy rights.
• Use that creates safety risks for others.

4. User Content and Responsibility

• You are responsible for content you create, upload, or share.
• Location information and recommendations can change; users must verify details independently.
• If you post on behalf of a business or organization, you represent that you are authorized to bind that entity.

5. Intellectual Property and License

• PixoMap retains rights in the app, service, and branding.
• You retain ownership of your content.
• By sharing content through PixoMap, you grant PixoMap a non-exclusive license to display and distribute that content for service functionality.

6. Subscription and Billing

• In-app subscriptions are processed through Apple In-App Purchase.
• Subscriptions auto-renew unless canceled in your Apple subscription settings.
• Refunds are handled by Apple under Apple's policies.

7. Indemnity

You agree to indemnify and hold harmless PixoMap and its personnel from claims arising from your misuse of the service, your content, or your violation of these Terms or applicable law.

8. Disclaimer of Warranties

The service is provided "AS IS" and "AS AVAILABLE" without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, PixoMap is not liable for indirect, incidental, special, or consequential damages. Maximum aggregate liability is limited to subscription amounts paid by you to PixoMap in the 12 months preceding the claim.

10. Pre-Dispute Notice and Resolution Window

• Before filing a legal claim, send written notice to [email protected] with subject "Legal Notice".
• Both parties agree to attempt good-faith resolution for at least 30 days from notice.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of courts in New Delhi, India.

12. Termination and Modifications

• We may suspend or terminate access for violations of these Terms.
• We may modify these Terms; continued use after updates constitutes acceptance.
